Terms of Service - FairlySplit

Welcome to FairlySplit. By accessing or using our website and application, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

1. Description of Service

FairlySplit is a free, web-based expense splitting calculator. It is designed to help groups of friends, family, or colleagues calculate and divide shared expenses, track who owes whom, and prepare settlement reports with payment methods (such as PromptPay or Bank accounts). The service is offered as a serverless, local-first web application.

2. Data Ownership & Storage (Local-First)

By default, all data you input into FairlySplit (names, expenses, payment details, and splitting history) is saved exclusively in your web browser's local storage (localStorage). We do not store, access, or control your data on our own servers.

Important Note: Because your data resides entirely in your local browser storage, clearing your browser cache, cookies, or local database, or using private/incognito browsing windows, will permanently delete your splitting history and configuration. You are solely responsible for managing and preserving your local data.

3. Google Drive Backup Integration

To help you manage your data across multiple devices and prevent accidental loss, we provide an optional Google Drive Backup feature. By using this feature, you agree to the following terms:

Authorization and Access: Connecting the backup feature requires you to authorize FairlySplit to access your Google Drive using the restricted drive.file scope. This grants FairlySplit permission only to read, write, and delete files that are explicitly created or opened by this application (specifically, the FairlySplit folder and fairlysplit-backup.json file).
Direct Sync: Data is synchronized directly between your browser and Google's servers. We have no access to your Google account, credentials, authentication tokens, or backup files.
No Liability for Sync Errors: The Google Drive backup feature is provided on a convenience basis. We make no guarantees about the reliability, speed, or integrity of the backup file or the synchronization process. We are not responsible for any sync failures, data corruption, or loss of backup files caused by Google API changes, connection interruptions, or any other issues.
Revocation: You can disconnect and revoke the application's access to your Google Drive at any time through the app settings or via your Google account security panel.

4. User Conduct & Use Guidelines

You agree to use FairlySplit only for lawful and personal purposes. You are responsible for ensuring that all payment details (such as bank details or PromptPay numbers) that you enter or share are accurate and belong to the respective individuals. FairlySplit does not verify the validity of any bank accounts, PromptPay numbers, or splitting calculations.

5. Disclaimer of Warranties ("As-Is")

FAIRLYSPLIT AND ALL SERVICES, FEATURES, AND CONTENT THEREOF ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that the application will be uninterrupted, error-free, secure, or free of bugs, or that the mathematical calculations of expense splits will always be 100% accurate for every edge case. We highly recommend reviewing your bill calculations and totals before making actual financial transfers.

6. Limitation of Liability

IN NO EVENT SHALL FAIRLYSPLIT, ITS CREATORS, CONTRIBUTORS, OR PARTNERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF FUNDS, FINANCIAL LOSSES, BANK TRANSFER ERRORS, AND DATA CORRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APPLICATION OR THE GOOGLE DRIVE BACKUP FEATURE.

7. Changes to Terms

We reserve the right to revise or modify these Terms of Service at any time. Any changes will be posted on this page with an updated "Last Updated" date. Your continued use of the application after changes are posted constitutes your acceptance of the updated terms.
